It looks related to Template:Free media (Q7856260) at Wikidata (albeit not itself linked to the item), but since all media on Commons is free then I cannot see what point this would serve. This picture was used by mistake and obiously taken by mistake: it shows just an ordinary wall and gateway and not Walls and Gateway in Front of Hunter Hall. Compare the coordinates given here and on Wikidata (item Q26438517), see these places in Google Streetview, see https://historicengland.org.uk/listing/the-list/list-entry/1145368! I do not believe that the bot User:FlickreviewR 2 was right when it confirmed this image to be "licensed under the terms of the cc-by-2.0". Firstly, that's not the license that is claimed here, which is PD-USGov-NRC. Secondly, the Flickr post and the file description clearly identifies it as copyrighted, with all rights reserved by American Academy of Achievement, a non-profit organization that is not part of the US government. On their website https://www.flickr.com/people/nrcgov/, NRC explain that "Unless otherwise indicated, the photos posted to the NRC’s Flickr account are in the public domain and may be reproduced freely", but continue: "Some content may contain a specific Copyright Notice. It is your responsibility to contact the copyright owner to obtain permission before making use of this content." That is the case here. I unfortunately don't believe the image was the Ministry's to license. The picture is most likely made by Rijksvoorlichtingsdienst, more specifically Valerie Kuypers (see here). For the past years, the Rijksvoorlichtingsdienst has refused a free license for their photos, including the bordes scenes. The Ministry of Defence has probably just used the photo from within government, without thinking about the copyright differences (including the fact that they dont mention the photographer).   • Keep it is released on a government site with valid permission from VRT. A similar case which can applies here is from this [] if we delete valid cc licence from other government websites we can delete all pictures from ministry of defence as it makes their CC licence worthless. If you upload pictures here from ministry of defence you need ask additional permission for portrait rights https://english.defensie.nl/service/copyright and we already have this.     My point has nothing to do with portrait rights. The government might not have the copyright at all ("Op foto’s, video’s, infographics en alle andere vormen van beeld is de CC0-verklaring niet van toepassing, omdat er auteursrechten van derden op rusten.") and the copyright might still be with the photographer. And if the government did have the copyright, it is most likely not the Defence ministry to license it, given that the Rijksvoorlichtingsdienst has made it and refused reuse.
    The VRT permission applies to all of the website of the Ministry of Defence (I guess), but I would assume it does not apply to pictures where the Ministry does not have copyright and thus ability to license. Dajasj (talk) 17:56, 11 March 2026 (UTC)

Dan mag u het niet gebruiken" (If a text or image (such as photos and videos) is specifically copyrighted, you are not allowed to use it) - that is, in case a specific (copyright) attribution is mentioned on the applicable page or any visual in that page of the defence website. Furthermore, given the recognizable persons in the photo, "GDPR applies to photos and videos that depict individuals [...] permission must be requested via [email]". It seems to me the latter formally also applies, even though one may consider these persons not to be random individuals that would require specific permission for each and every photo. But that aspect I am not sure of. Make of it what you will, but this implies that the photo itself is free to use under the general MinDef attribution rules by means of the way it is presented on the page (ie without a specific copyright mention). All we know for a fact is the copyright statement and within that frame, the photo is legit to share and legit to upload on commons (except the potential GDPR clause which may not he applicable in amy case). The rest is only hypothesis, even if we would consider a certain scenario as you describe as a likely one. We haven't established that as a fact. In order to do that, we should get confirmation from MinDef. Lacking that and still concluding the photo would not be allowed to upload to commons, lacking the correct permissions, would open up disputing all MinDef photos.     I disagree. In this specific case there is evidence that minDef might not be the copyright holder (there are a lot of minDef photos without this doubt). I think the template used is incorrect. {{Mindef}} should be replaced {{Rijksoverheid}}, which lists the raised itssues about 3rd party copyright of phones made after 2015. https://www.rijksoverheid.nl/copyright provides a means to contact them about copyright: https://www.rijksoverheid.nl/contact/informatie-rijksoverheid/e-mail-sturen. It might be useful to ask about the other bordesfoto's on https://www.rijksoverheid.nl/regering/over-de-regering/kabinetten-sinds-1945. The template {{Rijksoverheid}} has a clear cut off in 2015, all newer photos require explicit permission of the RVD (and you say they're refusing it) or from the photographer (in all these cases: Valerie Kuypers). It her permission cannot be obtained this bordesfoto has to be removed as well.
