Roth is definitely younger in this image than in the image en:File:Emery roth photo.jpg which the English Wikipedia uses as "fair use". The image could therefore be in the public domain, but would require attribution, including the year of publication and, if known, the author.   • The issue is that there is a high likelihood the uploader is not the copyright holder and has no authorization to release the image under a Creative Commons license.
