@A.C.O.M.S-2023: 11. IMO, "Property of Pindad" watermark indicates that Pindad is the copyright holder, and republication by the Ministry of Defense does not transfer or waive that copyright.

31. pretty much same as above, and I dont think removing watermark would be a good idea, there is a proposed policy warns about legal issues related to removing ownership or copyright watermarks, see Commons:Watermarks#Legal issues with the removal of watermarks. @Ckfasdf: Referring to Article 43 of Law 28 of 2014 on Copyrights, paragraph (b) it says: "Any Publication, Distribution, Communication, and/or Reproduction executed by or on behalf of the government,...."

So it doesn't matter even if the image is originated/ created/ claimed properties by the outside of government. As long as it is taken from the source published, distributed, communicated, and/or reproduction executed by on behalf of the government (Ministry of Defense of the Republic of Indonesia), the license should be included as {{PD-IDGov}}.

Also, the explanation (Penjelasan) section of Article 43(b) provide example what kind of publication, distribution, communication, or reproduction that is not a copyright infringement, and it was the one carried out using state funds. @Ckfasdf: Article 43(b) doesn't talk about "produced" (first created). It explicitly talk about "publication", "distribution", "communication", or "reproduction", which these action(s) was carried out in the government's account/website, by the government, not by Pindad.

Therefore, the process of "publication", "distribution", "communication", or "reproduction" by the government in their account/website is also using government's funding. These process has nothing to do with state funding.

And if the argumentation is relied on the funding, the argumentation will become more contradictive, because all State-Owned in Indonesia are funded with State Capital (''Penyertaan Modal Negara'') by the government through Ministry of Finance.

I should not have used the word "produced". It should be "published, distributed, communicated, or reproduced", as stated in the law. Earlier, I just wanted to point out that the elucidation (Penjelasan) section of Article 43(b) gives examples of what kind of "published, distributed, communicated, or reproduced" is not a copyright infringement, and it explicitly mentions those carried out with state funding.

Regarding a state-owned company like Pindad, even if it was first set up using state capital, once the company operates its funds are no longer treated as state funds. The term used by government/law is separated state wealth (kekayaan negara yang dipisahkan).

There is no such evidence of such license being applied at the source, therefor it retains Crown copyright. However, to me it looks like a self-made collage of an unproblematic logo and a blurry photo, which I could not find on the companies web site. Please elaborate, if it should be deleted. However, I cannot find it on this website and conclude that the link was just provided, to identify the building and the author, but not this specific photo. OK, 1.) Uploader claims to be the college, should be verified with VRT. 2.) Metadata shows a different from the uploader, could be a for-hire photographer so again, needs VRT. and since this is now a DR, 3.) Je ne suis pas du tout spécialiste, mais chacun peut constater que les droits détenus par l’éditeur (en l’occurrence, non plus Marvel mais Dynamite Entertainment), s’ils lui réservent sans doute l’exploitation éditoriale du personnage, n’excluent visiblement pas toute forme de référence ou de représentation. En creusant un peu, j’ai compris que nous sommes dans le cadre pas forcément très carré mais au moins assez bien cerné du fan art : j’ai ajouté le bandeau qui va bien (Hyjub avait déjà catégorisé dans le même sens). De Commons:Fan art, je retiens qu’il faut surtout éviter la simple copie d’une représentation protégée du personnage : autant que j’aie pu en voir, ce n’est pas le cas ici — c’est la Red Sonja de Rodrigo Catraca, et il l’a mise sous la bonne licence. --Fanfwah (talk) 04:58, 24 January 2026 (UTC)

@Fanfwah : à titre personnel, la perspective de pouvoir conserver ce fichier me réjouirait (cela donne tout de suite un certain cachet à l'infobox !). Toutefois, il me semblait que les conditions d'un fan art étaient plus restrictives que cela dans Wikimedia Commons... M'enfin, j'espère me tromper. Sollicitons des avis sur le bistro de Commons. Ainsi, au cas où votre interprétation serait confirmée, nous pourrions téléverser plusieurs dessins de Rodrigo Catraca pour illustrer quantité d'articles consacrés aux comics.

La recommandation Commons:Fan art ne me semble pas très restrictive : si le « Dessin d'un garçon avec des cheveux noirs, des lunettes et une cicatrice au visage en forme de zig-zag, avec ou sans la mention “Harry Potter” […] devrait être autorisé », je ne vois pas pourquoi celui d’une jeune femme avec des cheveux roux, une épée et un bikini en cotte d’écailles, qui plus est dépourvu de la mention “Red Sonja”, ne devrait pas l’être (sauf, bien sûr, à montrer quelle représentation spécifique originale du personnage aurait été copiée).

Commons:Derivative works rend un son de cloche sensiblement différent (« Vous ne pouvez pas créer et diffuser librement un dessin d'Albus Dumbledore, pas plus que vous ne pourriez distribuer votre propre film de Harry Potter ») et sa section COMMONS:CHARACTER me laisse perplexe. J’aurais tendance à considérer qu’il s’agit d’une recommandation plus générale et que dans notre cas c’est celle sur le fan art, plus précise, qui devrait s’appliquer. Mais plus d’avis sur l’état de la jurisprudence Commons seraient effectivement bien utiles pour arriver à une conclusion généralisable.

Le dessin est daté de 2018, je l’ai téléversé ici en juillet 2025 : peu de risque de copie du personnage du film, sorti en août 2025. Côté images statiques, l’idée de la rousse à épée, cuissardes et bikini d’écailles a bien sûr déjà été illustrée par de nombreux dessins protégés, mais si j’en crois Commons:Fan art, ce n’est pas suffisant : « afin d'établir s'il y a eu violation des droits d'auteur, les ayants-droit doivent être en mesure de présenter quelle réalisation spécifique (ou expression) originale et créative a été copiée ». J’ai un peu cherché, je n’ai rien trouvé et même si je ne peux évidemment pas prouver qu’il n’en existe pas, l’auteur du dessin en cause me parait assez talentueux pour être capable d’une création originale. --Fanfwah (talk) 16:50, 3 February 2026 (UTC)

This case bears resemblance to that of Commons:Deletion requests/File:The Amazing Adventures of Spiderman Entrance Islands of Adventure.jpg (US case, in a country where Freedom of Panorama is limited to buildings). However, there is no Freedom of Panorama for any copyrighted object in the Philippines. These images infringe on the sculptural copyright of these Spiderman statues.

These images are not free. They are trademarked logos. The uploaders have used CC 4.0 and CC 3.0 licenses even though there is no evidence to support a CC license. I don't think Commons would use a non-free template. The thing is, all but the 2nd file might be below COM:TOO Dominican Republic if we had the vaguest idea what their TOO was.
