Per the website of Nicolas de Vega Law Offices: A work of applied art is an artistic creation that possesses utilitarian functions or is incorporated into a useful article. Section 171.10 Intellectual Property Code of the Philippines states these can be made by hand or produced industrially. While artistic in nature, they serve a practical purpose in everyday use. They are protected as part of the literary and artistic domain under the Code. “171.10. A ‘work of applied art’ is an artistic creation with utilitarian functions or incorporated in a useful article, whether made by hand or produced on an industrial scale.   They're not likely to be utilitarian after all. The gongs are life-sized and part of Millan's modern exhibit on traditional music and weaving arts of Mindanao: the Ahungan ng Pagkakaisa. Per National Museum site, it is inspired by the traditional musical instrument of the Tagakaolo people, also known as tangungu in Bagobo, this centerpiece was masterfully crafted by over 50 skilled Manobo weavers, signifying the power of the community. So not 25 yrs. from creation, but 50-year post mortem auctoris (assuming Millan holds the rights on the artwork exhibit despite being made by many local craftsmen) or 50-years after the exhibit year of 2024, if the National Museum can be considered as the copyright holder of the indigenous artwork. I do not think under Canadian Law this work (a smiley face on a sign) is distinctive or original to be protected by copyright law. If we consider every simple smiley face under copyright protection, a lot of other things would considered an "original work". Additionally, the exception generally applies only to works on permanent public display. Per COM:TOO Canada, the threshold for an original work can be defined by three criteria :

• The work originates from an author and is not copied from another work;
• The work is the product of an author’s exercise of skill and judgment;
• The exercise of skill and judgment required to produce the work must not be so trivial that it could be characterized as a purely mechanical exercise.

I don't think that the drawing of a face under a speedbump on a sign is novel (it's quite common), and I don't agree that this is an exercise of a particular skill, i. e. the use of one’s knowledge, developed aptitude or practised ability in producing the work. It is not the (simple) text alone. It's the complete design of the poster with the background, maybe some type of photograph (not sure), the stylish cracks and the design. I would like to point out that a general rejection of AI-generated images is not, by itself, a factual argument for deletion. The relevant question should be whether this particular file meets the Commons criteria and whether it provides a meaningful contribution.

The statement that this is merely "senseless AI stuff" is a subjective assessment. This artwork is based on my own photograph of the former Markgröningen railway station and represents an artistic interpretation of a real place.

Furthermore, the argument regarding COM:NOTUSED does not apply in this case. The file is already being used by another Commons user on their photography page, which demonstrates that it has a practical purpose and is considered useful within the Commons community.

The origin of the file, the source photograph and the licensing information have been documented transparently. The file should therefore be evaluated based on its actual content, documentation and usefulness, rather than on a general opinion about AI-generated artworks.

@Albert Simoneschi: OK, then I'll get more into detail. As TLDR: such AI works are not meeting Commons' scope criteria.

1. A file that contains an AI simulated painting based upon a real photograph is not realistically useful for an educational purpose, it fails COM:EDUSE. True human-made paintings are available to illustrate painting techniques, there's no need for AI products or Photoshop filtered outputs for that endeavour. See also COM:SPAM: AI outputs that are "[f]iles that add nothing educationally distinct to the collection of images we already hold covering the same subject" are not needed or wanted.

1.1 There's educational usefulness to be had in documenting the current state or a location, so the photo that was fed to the AI would be fine.

2. The inclusion in automatically generated file lists is not pertinent to COM:INUSE.

3. Your talk page, sporting several DR notices, all related to AI transformations of real images, may serve as evidence of you abusing Commons, see COM:WEBHOST.

There are ample grounds to delete AI generated images like yours to be found in policies and guidelines, even if my summary of "senseless AI stuff" may appear as a bit to cheeky and shortened. Regards, Grand-Duc (talk) 18:37, 20 July 2026 (UTC)
