I contacted the uploader on her German WP user talk page a couple of days ago. She might somewhat solve the problem by verifying her identity as Victoria Gentsch, but in that case, the sentence "Nutzung nur bei vorheriger Genehmigung!" doesn't make any sense any more. I don't see that she has been active since though, and she certainly hasn't replied yet.
Another problem remains though: The image data currently say "© MATERIALMATTERS / Victoria Gentsch sowie Urheber der abgebildeten Werke und abgebildete Personen".
This is a totally nonsensical copyright note. The Urheber is the Urheber, and that's that. If not Ms Gentsch but one of her employees took the photo, then that person is the Urheber and not her. In which case we would need the consent by that person, not by Ms. Gentsch. The "abgebildete Personen" (image subjects), according to German law, have the Recht am eigenen Bild (personality rights concerning their own image) which is a right in itself but doesn't have anything to do with the Urheberrecht. --~2026-32013-56 (talk) 07:59, 29 May 2026 (UTC)
There are two additional issues:
  • These pictures were taken inside a mall. I don't see that freedom of panorama applies. What is the legal situation of pictures taken inside that mall?
  • On her German WP user talk page, the uploader has now said that she had marked (or meant to mark) the images as public domain. It seems that there are some grave misunderstandings about the applicable legal concepts. Obviously the photographer(s) of her images - be it herself or one of her employees - cannot have been dead for 70 years.

Linking to the image offsite (as you were doing) is also sufficient, I don't see how this was failing COM:AIIP.

In order to be public domain, it would need to be shown that the magazine was published without a copyright notice, per {{PD-US-no notice}}. The photo of Wendy Yoshimura is by Nancy Wong (the uploader, who is OTRS verified), and it can be seen in full at File:Wendy yoshimura in 1976.jpg, so there's no issue there, but the other photos are by Tim Zemberoff and the article is by Pete Axthelm, so we would need permission from them or from Newsweek to freely license the whole page. clpo13(talk) 15:50, 2 October 2018 (UTC)

The renewal template is trivially inapplicable, and a 1975 issue of Newsweek clearly shows a copyright notice for Newsweek. Magazines, unlike newspapers, almost always affixed proper notice, so evidence would have to be produced that this specific issue inexplicably lacked notice. Given that this user has only ever uploaded this photo, that this photo does not credit the author, somehow is published by a communications department but has no URL source leads me to believe this is not actually public domain. Copyright violation. This is an old upload of mine from 8 years ago. I just came across it again and noticed the wrong use of "own work" as the source. Unfortunately, it turns out the software I used explicitly forbids commercial use in their license , and has already done so when it was uploaded . Renerpho (talk) 21:42, 29 May 2026 (UTC)

The relevant part of the image is a map of Earth, its terminator, and a faithful depiction of data showing the occultation track of a body. This might actually fall under pd-map except for the artistic choices made in the image, which are fairly minimal.
