I don't think de minimis applies to this photo depicting the "Survivor Series" logo. I question how "free" the billboard poster of the logo is. Still under copyright in the U.S. I forgot that these also have to no longer be under copyright in the U.S. because Wikimedia Commons is hosted there even though the copyright for these has expired in the country of origin.     Randy, that's really not how it works. It was a public event marking the end of the temporary exhibition of the sculpture. Of course he would be present, and of course he would want people to take photos of him with the sculpture, but that is completely different from giving permission for images of this copyrighted artwork to be monetized by third parties (an essential requirement for photos to be allowed on Commons). 19h00s (talk) 22:55, 25 March 2026 (UTC)

    Yes, the high resolution photos are copyright violations unless Argote gave you explicit permission to publish these images under that free license, thus giving third parties the right to monetize the images of Argote’s sculpture. And honestly it makes no difference that Argote knows these images exist/are on Commons, unless he gave explicit prior approval with knowledge of what the free license entailed (telling him “so it’s allowed for use on Wikipedia” or something similar is not enough of an explanation imo, he needs to know what a free license actually is)
    I created and added the low resolution fair use image directly to the article on English Wikipedia months ago specifically because we cannot host high resolution photos of the sculpture. 19h00s (talk) 13:45, 26 March 2026 (UTC)

Keep. COM:FOP for the United States says 'public artwork installed before 1931 is considered to be public domain, and can be photographed freely. In addition, any public artwork installed before 1978 without a copyright notice is also in the public domain (unless the copyright owner actively prevented anyone from copying or photographing the work until 1978). The Prodigal Son in San Diego is a cast from 1905, so before 1931. In addition, Auguste Rodin died more than 70 years ago, so I think the copyright has expired(?)
