Bangladesh Copyright Act, 2000 is now superseded by a new 2023 act, which deems all government publications as copyrighted until 60 years of their publications, (See Article 28 of Bangladesh copyright act, 2023). The new act cancels the older 2000 act and hence all its old copyright provisions of government publications are also considered null and void. In that case, we do not have any other option but to delete all Bangladesh government publications uploaded on Wikimedia Commons under this license template. @Bodhisattwa: Per COM:Copyright rules by territory/Bangladesh#Retroactivity of the laws and Article 127 of the Copyright Act, 2023, “The current Copyright Act, 2023 is not retroactive.” The 2023 Act does not apply retrospectively and therefore does not affect works that had already entered the public domain before 18 September 2023. Your position appears to assume that the new law restored copyright in previously published government works, but there is no statutory basis for that interpretation.
Bangladesh still follows common-law principles inherited from British jurisprudence. Under Section 6 of The General Clauses Act, 1897, the foundational South Asian statute enacted during British rule in India, "later amendments cannot revive copyright unless expressly stated". There is no provision in the 2023 Act that expressly restores copyright in works that had already fallen into the public domain.
Bangladesh is also a party to the Berne Convention. Article 18(2) of the Convention provides that “If a work has fallen into the public domain in the country of origin, it shall not be protected anew.” This establishes the international presumption against retroactive restoration unless explicitly legislated.
Per Commons:Copyright rules, "files hosted on Commons must be free both in the country of origin (as defined by the Berne Convention) and in the United States." In the United States, retroactive application of legislation requires clear congressional intent, as affirmed in Landgraf v. USI Film Products. While the U.S. restored certain foreign copyrights under COM:URAA, Bangladesh has enacted no comparable statutory mechanism restoring copyright in works that were already in the public domain.
There is precedent for retaining Freedom of Panorama works published before 18 September 2023, as discussed at Commons:Village pump/Copyright/Archive/2024/09#Bangladesh. The present situation is analogous.
Accordingly:
  • Works created before 2023 but first published after 18 September 2023 should be evaluated under the 2023 Act.
  • Works in copyright and published after 18 September 2023 are subject to the 2023 Act.
  • Works published before 18 September 2023 that had already entered the public domain should not be retroactively removed.
The 2023 Act explicitly states that it is not retroactive. Even absent that clause, the argument for automatic restoration would not be legally sustainable.
I encourage a careful review of the governing statutes, relevant international conventions, judicial principles, WIPO guidance, and prior Commons discussions before proposing mass deletions. Tausheef Hassan (talk) 14:51, 14 February 2026 (UTC)

 Keep @Goesseln: I see no valid reason for deletion. The author has been corrected, obvious mistake easily corrected. The document is almost certainly in the public domain: it is probably be PD-ineligible (the text is short and simple, even the photograph is a basic and unoriginal mugshot) and in regular public domain due to its age (clearly PD-US since it's more than 95 years old and PD-anon-70-EU). All of these have been published elsewhere in websites and social media by Universidad Academia de Humanismo Cristiano (Academy of Christian Humanism University), before they were published here in Commons:

There is a possibility that the uploader is also the person who took these photographs. However, given that they have been published before on other websites, and they are all related to the same university, there is also a chance that the user just took them from the internet. Hi. There is a statement on State Treasury website: Johtajien ja toimitilojen kuvat ovat pääasiallisesti hyödynnettävissä CC BY 4.0 -lisenssillä. That page is not translated in English, but "pääasiallisesti" means mainly, so mainly all photos on photo bank are published with cc-by-4.0 but not necessary all. This photo is also cropped between State Treasury website and Wikimedia Commons. In file information should be mentioned source i.e. link to photo bank page, where is the photo, including its licence and photographer's name. I suggest you send email as mentioned here to permissions-commons(at)wikimedia.org or if you prefer in Finnish, use this instead, then email is permissions-fi(at)wikimedia.org. Die hat kein Copyright. Einerseits, weil es das im kontinentalen Europa nicht gibt, sondern das Urheberrecht, welches Hirschfeld hatte und das dann auf dessen Erben über gegangen ist. Societies in Germany can hold the exclusive rights of use ("ausschliessliche Nutzungsrechte") if they were transferred to them by the copyright holder which isn't exactly the same as holding the copyright, but amounts to about the same in practice, see de:Nutzungsrecht; so, it's possible that the Magnus-Hirschfeld-Gesellschaft was the holder of the rights of use of Hirschfeld's works until 2005 (70 years after Hirschfeld's death), but these would have then expired with the expiration of copyright, too. Das ist doch irrelevant. Hirschfeld starb 1935. Seine Arbeiten sind demnach seit 2006 in der Gemeinfreiheit. Wobei hier sogar hinterfragbar wäre, ob es eine Schöpfungshöhe gibt. Ein Scan kann man schwerlich als schützenswerte Reproduktion betrachten. Auch die Person um die es geht dürfte lange genug verstorben sein, dass es keinen Einfluss mehr auf das Leben nehmen kann. Es gibt gar keinen Ansatz, gar keine Rechtfertigung für eine Löschung. Ich finde den Versuch schon überaus irritierend. Das ist eine Form des Elfenbeinturms, von dem ich dachte, er sei überwunden. Das Archiv der Magnus-Hirschfeld-Gesellschaft mag das Originaldokument besitzen. Das schließt aber nicht das Eigentum am Inhalt ein. Denn das ist seit 2006 hinfällig. Es ist m.E. möglich, dass die Magnus-Hirschfeld-Gesellschaft Rechte an diesem Gutachten für sich beanspruchen kann, aber nur unter folgenden Umständen: Erstens, der Text ist überhaupt schutzfähig (hat Schöpfungshöhe), was zumindest Rosenzweig hier verneint. Zweitens, das Gutachten wurde nie veröffentlicht, solange es noch urheberrechtlich geschützt war (70 Jahre nach Hirschfelds Tod, also bis und mit 2005). Drittens, die Magnus-Hirschfeld-Gesellschaft hat das gemeinfreie Werk danach veröffentlicht. Dadurch könnte sie dann den Schutz der Editio princeps für sich in Anspruch nehmen, der für 25 Jahre nach der Erstveröffentlichung bei eigentlich gemeinfreien Werken praktisch einem urheberrechtlichen Schutz entspricht. D.h. angenommen, die Gesellschaft hat das Gutachten 2010 veröffentlicht, wäre sie m.E. noch bis 2035 Rechteinhaber. Aber das wäre belegt darzustellen. Unklar ist mir, wie die Lage ist, wenn die Erstveröffentlichung erst hier durch den Upload durch den User "Theirstory historian" erfolgt ist, d.h. wenn dieser User die Datei von der Gesellschaft erhalten hat, aber "nicht zum öffentlichen Gebrauch". Ist dann Theirstory historian durch den Akt der Erstveröffentlichung Inhaber des Rechts der Editio princeps geworden, obwohl dies unautorisiert erfolgte...? Hirschfeld stellte die Bescheinigung am 23. November 1932 aus, Katter legte sie wahrscheinlich der Polizei vor, damit war die Bescheinigung öffentlich. Sie war wahrscheinlich eine Grundlage für den am 6. Dezember 1932 vom Polizeipräsidenten ausgefertigten polizeilichen Ausweis mit Passfoto und Stempel, der ist per se öffentlich und hat auch keine Schöpfungshöhe, da hier ein behördlicher Standardtext mit Personenangaben vorliegt. Ein Passfoto hingegen ist wiederum so ein urheberrechtlich eigen Ding...

Eine Vorlage an die Polizei ist m.E. keine Veröffentlichung. Wenn jedes Werk, das einmal einem begrenzten Personenkreis zugänglich gemacht wurde, veröffentlicht wäre, dann wäre alles veröffentlicht, was nicht gerade von niemandem sonst betrachtet in der Schublade des Autors liegt. Dass eh keine Schöpfungshöhe vorliegt, halte ich aber auch für wahrscheinlich, womit sich die Editio-princeps-Diskussion dann auch erledigt hätte. Gestumblindi (talk) 11:16, 14 February 2026 (UTC)
