  • The music "Fun is Fun" by Aylex at freetouse.com (link here) only indicated a "Free to use" license, not licensed under a CC license as claimed by the uploader. Per their license terms, it prohibits use in "Commercial Content, Broadcast Content, Digital Products, or Physical Products", which is not compatible with Commons.
  • Adobe Express and CapCut having a "free version" that can be used free of charge, doesn't mean their content are freely licensed.

In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Ukraine.

It's not the building's complexity that's relevant, but whether enough of it can be seen, with enough prominence. The building here is very prominent and very recognizable. I'm completely confused by the legalese here and its purported relevance to Commons. If this is above TOO in the U.S. then there is a copyright here, and (apparently) no license, if not, not. OK, let me reword. The only reason quoting this legalese would be relevant is if they are saying our hosting this is violating their contract. I also found this 2022 undeletion request where same problem was raised (possibly in relation to the same photo?). Additionally, a user who we can presume is the same person has repeatedly uploaded a copyrighted image without permission (User talk:Ransmyr~commonswiki). I suspect copyvio is the case here too. AI generated art is in most cases slop. It’s generally stolen without credit from human artists, photographers, and creators and produces inferior-quality results that can only be described as looking “gloopy”, like everything is kind of melting together. That's an opinion, not an objective fact. Not all AI generators are trained on stolen work (although I do know many are from "stolen" sources, although courts are still deciding if that counts as stealing those works to train on them) and it seems to make more sense to try to negotiate a Commons rules change to not allow AI if you hate it so much, instead of having a wild deletion spray of work people made and shared under good faith. Besides, have courts decided that training on but not using copyrighted works is infringement? Last I heard, it is seen as a different thing legally. @Dronebogus: The painting is positioned high on the wall with a canopy directly below it. This means the only way to get a clear, straight-on shot is to use a ladder; otherwise, you can only see it from a sharp angle, as the photo shows. I don’t understand why using an AI version for illustration is an issue, especially since I intentionally generated it in a pencil drawing style so it would be immediately obvious that it isn't a photo. As I noted on the description page, the drawing style is intentional so that it is immediately clear this is not a photo. This image is not of Hiroshima or Nagasaki, nor any actual nuclear detonation or mushroom cloud. It is a CGI mushroom cloud image that has circulated on the Internet for a long time. It is obviously fake — it has a cloud face rendered into it. Its copyright status is uncertain — I do not believe the user who has labeled it as their own image created it, particularly because they apparently are trying to pass it off as an actual photograph of a mushroom cloud. Since the Doug flag is explicitly copyrighted with commercial usage prohibited (see its category page), any derivative work of it or an image of it in public display (which does not meet de minimis) is not permitted on Commons. I have thus nominated all images where the flag is either used in a derivative work (excluding those where {{PD-Shape}} would apply), or is displayed so prominently in the image it does not meet de minimis. Following further discussion below, I have withdrawn all variations of the flag which do not contain an identical copy of the tree design, have been blurred, or which most likely meet de minimis.

The presence of the flag in File:March Against Monsanto, Eugene 05.jpg appears to me to be de minimis. The tree, which is the only copyrightable component of the flag, is virtually undetectable on the flag at left, and can barely be parsed on the flag at right. If a potential closing admin disagrees about either of those, I will gladly do similar things with a Gaussian blur to what I did for the Fremont Solstice parade photos, but in this case I don't even think it should be necessary. - Jmabel ! talk 06:23, 22 March 2026 (UTC)

I honestly think the US copyright office made a mistake when they registered the copyright for the original flag, given how utterly basic it is, but they did register it nevertheless.
How derivative is it permitted to be with regards to the tree design? I would think it has to be at least very close to identical to constitute copyright infringement. Trademark law might cover something broader, but as I said above (06:16, 22 March 2026), the general design of a flag is analogous to a blazon. You can't copyright "Douglas fir on a green-white-blue horizontal tricolor." You can copyright a particular photo or drawing of a Douglas fir. - Jmabel ! talk 17:31, 22 March 2026 (UTC)

File:Cascadia-flags.png can easily be edited to obscure the doug flag. No reason to delete. Overreach on almost all of these, as the original user has admitted for many.
