Obvious mislicensing, uploader apparently not identical to author/copyright holder Lutheraner (talk) 00:26, 27 February 2026 (UTC)

@Lutheraner why do you think it's 'Obvious mislicensing'? my name and surname are in exif, if you don't believe me, I can send you the raw file Gower (talk) 05:45, 27 February 2026 (UTC)
@Lutheraner moreover look at the: Category:5th Silesian Science Festival, most (perhaps all) of photographs in that category is created and uploaded by me. Gower (talk) 05:51, 27 February 2026 (UTC)
The file metadata lists a PENTAX K-5 II s. From experience, Gower has uploaded numerous files to Commons that were taken with this equipment. The photo, of course, should be retained. MacQtosh (talk) 05:48, 27 February 2026 (UTC)
@Lutheraner 'Obvious mislicensing'? - could you explain? At this time, the applicant's claim is not supported by facts.KrzysztofPoplawski (talk) 07:35, 27 February 2026 (UTC)

File:Abdulaziz Meslat.jpg

It’s fake photo, and I don’t know who prepared this photo by photoshop Aalmeslat (talk) 00:36, 27 February 2026 (UTC)

Probably should be  Deleted just like the other version of this image (File:Dr. Abdulaziz Meslat freemasonry.jpg). The image might be a photo montage of this. It was seemingly uploaded for self-promotion intended (?) for w:ar:عبد العزيز دحام المسلط? There may also be some sockpuppetry involved (because why would the uploader randomly post a biography on another new user's user page and user talk page?).
And then things just get strange because the filer of this DR also uploaded two images of the very same guy (File:Dr. Abdul Aziz Meslat.jpg and File:Dr. Abdulaziz Meslat.jpg). Nakonana (talk) 10:23, 20 April 2026 (UTC)
And the filer's username matches the name of the depicted person while neither of the images look like selfies. Nakonana (talk) 10:27, 20 April 2026 (UTC)

Files in Category:Photographs by Van Leo

w:Van Leo died in 2002. Per COM:Egypt, his work thus only enters the public domain 50 years pma, so 2053, and is therefore currently protected by copyright. (Some files struck out by nominator due to apparent minimal creative input.)

Howardcorn33 (💬) 02:27, 27 February 2026 (UTC)

See the licensing template:
"Egyptian works that are currently in the public domain in the United States are those whose copyright had expired in Egypt on the U.S. date of restoration (January 1, 1996) pursuant to the provisions of the old 1954 law which was in effect at the time. ...Copyright has expired in Egypt if... Non-creative photographic or audiovisual works...published prior to 1987"
Looking at the Taha Hussein photo for example; as it was published in 1955 and is a simple portrait shot, it would be considered out of copyright. I'm sure others have better judgements on which other photos this also applies to. Ringtail Raider (talk) 09:07, 27 February 2026 (UTC)
Clearly at least some of these photos have professional artistic input as Van Leo has, according to his wikipedia page, "been called an artist for turning his photography into art" and the article goes on to describe his recognition as an artist. – Howardcorn33 (💬) 09:35, 27 February 2026 (UTC)
@Ringtail Raider: I've now struck out particular files which appear to be minimally creative, although given Van Leo's reputation, these are only a  Weak keep from me. – Howardcorn33 (💬) 15:39, 27 February 2026 (UTC)

Weak delete per nom. This is a photograph of the screen of a QR code scanner, not sure if the depicted "image" in the phone is copyrighted (since it's like taking a picture of a mirror). However, since a person has to set up the phone (with its camera) and decides its angle, framing and lighting, along with the fact that COM:TOO HK is very low, I would guess the "image" displayed in the phone is copyrighted. File:Coat of Arms of the Archdiocese of Manila Vectorized.svg

This file is a derivative work of the official, copyrighted depiction of the Archdiocese of Manila's coat of arms.

Although the uploader substituted the internal heraldic charges (the crescent, castle, and merlion) with CC BY-SA assets from File:Coat of Arms of the Archdiocese of Manila.svg, the rest of an image is an exact trace of the archdiocese's specific artistic representation. Per Commons:Coat of arms, the visual emblazonment is protected by copyrighted:

A representation drawn to imitate another representation containing non-geometric shapes is not copyrightable separately from the original work. If the goal of the author is to replicate a single preexisting work as precisely as possible, the result will have no copyright beyond that of the original work, and will thus be considered a derivative work of the original (and is protected— or not— under the same copyright).

Specifically, the derivatives are evident in the exact vector replication of the following: the exact curvature and border of the shield, the detailed stylization of the mitre (including the ornamental leaves), and the folded scroll. P-JR (talk) 08:05, 27 February 2026 (UTC)

File:Dülmen, Intergeneratives Zentrum "einsA" -- 2024 -- 0157.jpg

Unfortunately, German Freedom of Panorama does not cover drone images of copyrighted works, as per the infamous 2024 decision of Germany's highest court (English source, German source). According to the highest court, airspace is "generally inaccessible to the public," and drone images of copyrighted public landmarks should not be distributed or marketed online. German FoP only protects images taken from the ground level, not from the airspace or mid-air.

This building was built in 2020 and authored by dreibundarchitekten BDA from the city of Bochum. JWilz12345 (Talk|Contributions) 08:42, 27 February 2026 (UTC)

@XRay the discussions and forums reference the 2020 Frankfurt-am-Main court ruling, which has since been reversed by the "Supreme Court" of Germany (the Federal Court of Justice). We cannot use the 2020 Frankfurt-am-Main decision now. Read this (which I actually posted it here). JWilz12345 (Talk|Contributions) 10:06, 9 March 2026 (UTC)

Question Does that mean that images taken from airplanes, helicopters, and hot air balloons are also not covered by German FoP? Nakonana (talk) 12:35, 20 April 2026 (UTC)
@Nakonana yes, as far as court rulings are concerned. See the extensive commentary at COM:FOP Germany. It is an unfortunate situation that only images taken from the ground level are covered, not airspace. Perhaps it is due to the fact that airspace is technically not a public place. People cannot access it without restrictions such as airport security, inspections at hot-air balloon sites, or the most basic is securing permission from the owner, operator or the pilot of the aerial vehicle or device before being able to visually access and inspire the views of copyrighted art and buildings from the mid-air.
Balloons are included in the German panoramafreiheit legal commentaries. JWilz12345 (Talk|Contributions) 15:17, 20 April 2026 (UTC)

Strong keep: For now, I’ll keep it for sure. The reason: Even though I didn’t want to, I contacted the architectural firm and asked for permission. How does de minimis apply here? The whole focus is on the graphic work. Traumnovelle (talk) 03:17, 1 April 2026 (UTC)
I'm guessing the assumption is that the text and geometric shapes are not copyrightable per the threshold of originality. The only copyrightable thing would be the image of the pizza, but the pizza is out of focus and thus de minimis. Nakonana (talk) 12:58, 20 April 2026 (UTC)

Would you be able to confirm your identity to COM:VRT? Commons unfortunately cannot accept good faith attestations of authorship of previously existing images without proof. Whether or not the image is appropriate for Commons would depend on the precise nature of your agreement with Universal, but given Universal apparently owns the underlying rights to the image I am not convinced that it can be legally uploaded to Commons without their consent. Hemiauchenia (talk) 17:04, 27 February 2026 (UTC)
Yeah, the problem is that even if they gave you permission to use it for promotion and such, that is not the same as saying anyone else can use it for anything, which is essentially what is needed for Commons. FunkMonk (talk) 17:12, 27 February 2026 (UTC)
Does Universal own the rights to that image given that it's seemingly a mirrored version of File:Blason ville fr Louppy-le-Château (Meuse).svg. If the Commons image came first, wouldn't they need to publish their version under a similar license ("share alike")? Or is the user-created COA infringing Universal's copyright? There is a template on the pages for these images saying,
"This image has been extracted from another file: 2025-06-03 Wales V Italy js 103.jpg.
The source file was deleted for reasons that do not affect this image, like a derivative work which is not a part of this cropped image".
Helper201 (talk) 17:31, 27 February 2026 (UTC)
Yeah, the template is a bit too optimistic claiming so. --Geohakkeri (talk) 17:42, 27 February 2026 (UTC)
This is a long-standing bug in that template. It will always display that message if the source file has been deleted, regardless of the deletion reason. Omphalographer (talk) 06:12, 28 February 2026 (UTC)
That's not a bug at all. Images can be cropped to remove things that are protected by copyright. The crop can then be kept while the original needs to be deleted, but due to the requirement of attribution in the CC license it's still necessary to link/point to the original file. File:Tsukuba-chuo ic.jpg

This file was initially tagged by LERK as Speedy (speedydelete) and the most recent rationale was: "Tsukuba-chuo" and "Ibarakikuko-kita"("Ibarakikuko" means Ibaraki Airport) are not same. As I do not understand Japanese language, I create a regular deletion request. Taivo (talk) 16:45, 27 February 2026 (UTC)

{{vote delete}} misidentified thus useless redirect. Mzaki (talk) 12:05, 26 March 2026 (UTC)
Weak keep the redirect. While the misidentification may be true, the file was available under this incorrect name for 15 years before it was redirected to its correct identification (if I'm reading the file log correctly), so that there's too high a risk that external websites are still using the old file link. Deleting the redirect might break the linkage of external websites to this file.
It also looks like @Túrelio: specifically recreated the redirect and so did @Sreejithk2000: ? Nakonana (talk) 16:10, 20 April 2026 (UTC)
Oh, I see. This is a trace of little bit strange COM:SPLIT. The following is the history:
  1. User:Filler uploaded the wrong (Ibaraki Airport) version as File:Tsukuba-chuo ic.jpg, but quickly overwrote it with the correct (Tsukuba chuo) version in 2010. Thus, the File:Tsukuba-chuo ic.jpg points the correct version along most of its 15-year history.
  2. User:LERK found the COM:OW event and tag it with {{Split}}.
  3. The COM:SPLIT process restored the wrong version of File:Tsukuba-chuo ic.jpg, with renaming the correct version as File:Tsukuba-chuo ic (2).jpg.
  4. The wrong (Ibaraki Airport) version was speedy-deleted as a {{Duplicate}} of File:Ibarakikuko-kita ic.jpg, but keeping the redirect as usual.
  5. So User:LERK has requested deletion of the redirect, probably aiming to renaming the correct version File:Tsukuba-chuo ic (2).jpg to the long-standing name.
So  Speedy delete to restore the long-standing connection between the correct version and the filename File:Tsukuba-chuo ic.jpg. There is no risk of breaking linkage of external websites. Mzaki (talk) 11:13, 23 April 2026 (UTC)

This file was initially tagged by Gampe as Speedy (Speedydelete) and the most recent rationale was: neo-fascist propaganda . That may be a reason to add some sort of warning template or to alter the description, but documenting neo-Fascist propoganda is generally within Commons' scope. Jmabel ! talk 20:14, 27 February 2026 (UTC)

Also, while there might more likely be a copyright challenge here, I think this is a simple enough combination of highly conventional elements that it is probably below TOO in any country that does not have a super-low threshold. - Jmabel ! talk 20:17, 27 February 2026 (UTC)
There's the individual elements and their composition, and neither is licensed. This is fair use IMHO, not PD-textlogo. But reasonable minds can differ. - Alexis Jazz ping plz 12:43, 28 February 2026 (UTC)
Copyright and propaganda aside:
Whose logo is this and why would we want to host the self-created logo of a random Telegramm group of neo-fascists? (or whoever they are because I really can't find anything on them other than the Telegramm channel and an account on Russian social network VKontakte (vk))
Delete as out of COM:SCOPE personal art (with unclear copyright status because, if the group is really from Russia, then the threshold of originality might be so low that famously even a painting of a literal black square is protected by copyright). Nakonana (talk) 16:35, 20 April 2026 (UTC)

Out of scop: Personal fiction. The "Republik Freies Wendland" did not have a flag. It had a vertical seal (in much brighter colors!) and with the name written on it, just as can be seen in the "source" website for this file. Enyavar (talk) 21:15, 27 February 2026 (UTC)

@Enyavar Such flag is visible in the main photo posted on the source page (the flag is clearly visible at the top edge, but due to the photography technique, I recommend taking a closer look at the photo). What you described as a seal is their main symbol (banner/coat of arms/logo, I don't know which term describes it best), but this file also shows the symbol used. There is no doubt that these images were taken prior March 1, 1989. However, {{PD-US-1978-89}} requires it was first published before March 1, 1989. The source is a fan site and lacks any COM:EVIDENCE when these photos were published. I would say it was after Kurt Cobain / Nirvana became famous (their first album was published in June 1989). Per COM:PCP we cannot kept them.

Based on the discussion which took place at the Village Pump "Do_Newspaper_Staff_photos_qualify_for_{{PD-US-1978-1989}}?", these lack evidence of being 'published without notice'. The photos appear to be internal staff photos rather than a typical press or wire photo that was more widely distributed. They look to have been taken by paper staff for use by the Daily News itself only. Publication of the photos would have occurred when the newspaper copies they were included in were published to the broader public. By the mid-80s, it was common for newspapers to feature a notice in their mastheads. If the photos were syndicated or distributed out to other papers, that could constitute publication but there is no evidence of such. The omission of a copyright notice on internal news photos does not by itself demonstrate publication without notice. Delete per COM:PRP.

I was not aware of that. Do you have a source that says that plainly? I've tried looking that up and I wasn't able to interpret the legalese. BuckeyeSmithie (talk) 23:12, 2 March 2026 (UTC)
Commons:Copyright rules by territory/United States#Works by the US Government, This does not include works of employees of the USPS, as exempted in 1976 [1]. In particular, the USPS holds exclusive copyright to all US postage stamp designs since 1978 [2] (older US stamps are all considered public domain). Based5290 (talk) 02:24, 3 March 2026 (UTC)
The way I read that wiki page, and the original legal text linked, is that it probably is specifically talking about postage stamps. However, I can see how maybe the line "its works, including postage stamp designs" implies all works can be copyrightable. I'll take your word for it. Thank you for the information. Now that the NGDV is out in public there are other wikimedia photos available that do the job, (at the time this photo was added, the only available NGDV photos were USPS photos), so the articles using this photo won't really be harmed anyway.
