File:Gao wenhan 高文翰.jpg

This photograph was taken between 1950 and 1960 in the People's Republic of China. According to the Copyright Law of the PRC, the 50-year protection period for photographic works has expired, placing the image in the public domain within its country of origin. However, its status in the United States remains complex due to the URAA. Since the exact publication date is uncertain within the 1950-1960 range, the work was likely still under copyright in China as of the URAA date (January 1, 1996). Consequently, it may still be protected in the US under the 95-year rule for foreign works. I am initiating this discussion to determine if the lack of a precise publication date and potential US copyright restoration necessitate its removal under the Commons policy of precautionary principle. Kurgenera (talk) 01:11, 7 May 2026 (UTC)

Furthermore, the copyright status remains inconclusive even when applying the "Life + 70 years" rule. As the identity of the photographer is not definitively established or their date of passing is unknown, it is impossible to verify whether 70 years have elapsed since the author's death. @A1Cafel: do you have any specific reason to believe the 2D work there is not PD, or are you just saying it is unproven? (Looks circa 1910-1940 to me, so it is not obvious.) - Jmabel ! talk 19:06, 7 May 2026 (UTC)
It is unproven. The exact date is unknown. --A1Cafel (talk) 03:08, 8 May 2026 (UTC)
I can't work it out (in 10-15 minutes of work, all I could conclude was that all of the current buildings on Washington Square East are late 19th-century, are the same as in this photo, and so won't give us much of a clue), but perhaps User:Pharos can, or would know who can. - Jmabel ! talk 06:02, 8 May 2026 (UTC)

In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In about half of all countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Bulgaria.

Thank you so much for letting me know! I wasn't quite sure on the rules, and was mostly just trying to match context with other uploads on the pages affected. Just based on what has been selected, are the sculptures the defining features here? I have uploaded a couple other photos in the same timeframe that may not strictly meet the definitions listed, as they represent a theme park ride and a theme park show. Both have matching examples that have sat on their respective pages for quite a while, so I assumed they were safe to use. In case they also need to be flagged, just wanted to point them out. Thanks again for your help and words of encouragement!

Scoops929 (talk) 05:03, 7 May 2026 (UTC)
Scoops929, I did see those two photos as well. For those it's a judgment call, the sign of the Serengeti Flyer is quite prominent, but it also shows the attraction which has few decorative elements. For the sign, only the decorative leaves are a copyright issue, not the purple "Serengeti Flyer" text. Some would argue that the decorative leaves are de minimis in this photo, others would argue they're not.
On the "Scrooge No More" photo (good timing on that one!), I'd argue the primary subject consists of the actors, and their costumes consist of utilitarian clothing which is fine. The projected chains and fireplace could be an issue, but again, it's a judgment call. The general rule is "if the image would still be useful if we blurred the protected elements it's acceptable". - Alexis Jazz ping plz 05:25, 7 May 2026 (UTC)
That makes sense! Thank you so much for stepping in, this is super informative! I had a whole collection of photos I was planning to post so this will greatly narrow down what is within my rights. Scoops929 (talk) 05:24, 8 May 2026 (UTC)
There is FOP for architecture. Do File:Krazy Kat Toon Lagoon Universal Islands of Adventure.jpg and perhaps File:Display featuring The Phantom at Universal Islands of Adventure's Toon Lagoon.jpg just show architecture that includes reliefs and other decorations as part of it? I think a key point would be whether these are permanent features of it or are periodically changed. I figure the bird statue in File:Gertrude McFuzz Fine Feathered Finery Universal Islands of Adventure.jpg is sufficiently separated from the structure to be copyrighted. -- Ikan Kekek (talk) 16:18, 1 August 2026 (UTC)

The copyright status of SOHO images continues to be unclear. Unitl recently, due to the fact that it is a collaboration of NASA and ESA (PD-NASA applies to images created solely be NASA) and the copyright at the SOHO website doesn't mention if commercial use is allowed or not without permission, images based on SOHO were deleted per C:PCP (unless they were uploaded by ESA, with compatible license). But in the latest SOHO related deletion request (Commons:Deletion requests/File:C-2024 G3 (ATLAS) from SOHO LASCO C3 (54274839341).png), it was kept as a USA automated camera image. --C messier (talk) 18:24, 7 May 2026 (UTC)

Hi @Dronebogus! To be honest, I also hate AI slop, but I couldn't find a quality picture on Commons (and anywhere else) about a graduate cap with a transparent background. Sciences humaines.svg was the closest to it, but it has an unusual shape at the bottom, a strange shading on its top and it was released under a stricter license. gpt-image-2 can perform tasks like this really well: the result does not give me that general itchy feeling at all like when I see an obviously AI-generated image—quite on the contrary.

Neutral, previously I vote kept because it was in use, but it seems it is not anymore. I understand this image depicts a fictional concept, so it doesn't have to be realistic. However, in my opinion, this quality of this image is not good as there are some minor AI-generative errors, particularly in the abducted cow (e.g. some extra stuff at its legs, and it appears its horn is growing out of its right ear).
However, I agree with Prototyperspective above that there's "barely any illustrations of the subject", so my opinion is neutral at this point. Thanks. Tvpuppy (talk) 17:39, 14 May 2026 (UTC)

Keep as COM:INUSE. I don't know why Dronebogus started separate DRs for each of Theklan's AI images when they all had the same three-word deletion rationale. I'll paste this same comment onto all of the DRs where the image is in use. Belbury (talk) 16:44, 9 May 2026 (UTC)
I started separate DRs because I was going through the images one by one to ensure none of them were in use at the time I nominated. Dronebogus (talk) 06:07, 10 May 2026 (UTC)
You could still make that as a single DR, either manually or with Help:VisualFileChange.js which gives a tickbox for each image (as well as an easy way to see which images are and are not in use). Belbury (talk) 06:46, 10 May 2026 (UTC)
Why? Every image is different and might be its own case. Dronebogus (talk) 08:05, 10 May 2026 (UTC)
The cases can't be that different, if they're all uploaded by the same user and you gave every file the same DR reason.
Any complexities raised, whether as a reason to keep or delete this kind of image, may also apply to the other files. If I found that one of the images was actually a copyvio of an earlier work, I'd have to repeat this observation 22 times across the other DRs, if I thought it was worth taking into account in those other discussions. This is not the uploader's own work: it is pretty clearly a photograph of an information board at the site. @Tvpuppy: Actually, by searching a bit more here and there, I was able to find out (there are some photos and videos available) that show this map or a copy of it, if we take it for granted that the original one is in the museum, are present on the archaeological site of Ancient Corinth. A combination of book scans, newspaper clippings, and historic photos, mostly from Belgium, which has a copyright term of 70 years pma. None are old enough to be {{PD-old-assumed}}; some are tagged with {{PD-EU-Anonymous}}, however it is hard to believe that newspaper photographers or club photographers would be anonymous. Despite the claims on some that they have been released under CC-0 by the Belgian National Archives, I can find no evidence of such a release even assuming that the archives would own the copyrights.

Storkk (talk) 09:43, 13 April 2018 (UTC)

First of all, not all of these files have been uploaded by me, it would be nice to address the correct person if you want to discuss potential deletion requests; second, under Belgian law everything older than 1923 is public domain, so many of these should not even be discussed; and, third, it would be nice and advisable to check each license an source individually before putting such a list of files up for deletion without distinction ! All the files starting with KNVB, Anefo or NL-HaNA for instance are all part of the "Nationaal Archief" of the Netherlands and free to be used as per instruction on their website . Same goes for pictures coming from the French database Gallica , File:Btv1b6904915n.JPEG or File:Btv1b69049147.JPEG, for instance, are clearly tagged public domain. The video File:Voetbalwedstrijd Nederland - België (2-3).ogv, for instance, is an upload from a project called Open Beelden, a partnership between Wiki Nederland and the Netherlands Institute for Sound and Vision, which purpose it to make freely licensed multimedia material available ! As said, this is a list quickly compiled without any thorough checking... Garulfo71 (talk 13:15, 13 April 2018 (UTC)

Keep At least all files starting with NL-HaNA are licensed CC-zero by Dutch National Archives, and are from the collection of the Anefo photo press agency. There are currently more than 300,000 images from this collection in Commons, see Images from Anefo. See also Anefo in EN-Wiki, this article in Dutch, the website of the National Archive and GLAM Newsletter 2018. If there are any doubts about a particular image, then file a request for deletion for that image. Vysotsky (talk) 21:04, 5 May 2018 (UTC)
  • Keep. Most files look like obvious public domain photographs, similar to thousands of Commons files from the same sources, e.g. photographs from Anefo or Rol. Many seem correctly tagged CC0 as per their source. Some others seem incorrectly tagged CC0 and should instead be tagged with other PD tags, e.g. Rol photos are known to be PD-anon-70-EU + PD-1923 or + PD-1996. The solution is to ask the uploaders to use the correct PD tags, not to delete the PD files. The DR is an unmanageable list of files from various sources. If there are non-free exceptions, they should be the object of specific DRs with explicit rationales. -- Asclepias (talk) 22:04, 16 June 2018 (UTC)

Kept: the files with a clear and safe copyright situation (mainly Nationaal Archief), deleted the rest. {{PD-EU-Anonymous}} is often misused. Not everything of which we don't know who the author was can be somehow considered 'anonymous work'. Also many files are from the 1950s with unknown photographer. There is no way some archive can consider such files CC-0, such claimes are wishful thinking rather than reliable claims. --Jcb (talk) 18:24, 24 June 2018 (UTC)

These photographs, all of them published after 1975, might be in the public domain in Italy now, but they were not in the PD there in 1996, which means they are still protected in the US because of the URAA. They were uploaded with the {{Not-PD-US-URAA}} tag, but that is not allowed for new uploads after March 1, 2012. So the files should be deleted.

Rosenzweig τ 10:50, 7 May 2026 (UTC)

@Rosenzweig What do we do for the undeletion dates? My guess is that in the US these works would be considered as a corporate authorship since they were obviously made for hire for the Panini company... It'd mean adding almost every undelete category from 2072 to 2091. Friniate (talk) 15:13, 7 May 2026 (UTC)
@Friniate: Yes, one could add them all. For now, I've just added the earliest of them. Plenty of time over the next 46 years to add the others :-) --Rosenzweig τ 17:28, 7 May 2026 (UTC)
@Rosenzweig Done. Friniate (talk) 22:12, 7 May 2026 (UTC)
@Rosenzweig Hi, I never noticed the message that the {{Not-PD-US-URAA}} tag was not allowed for new uploads after March 1, 2012 in previous times I used it Has this been added recently ? And why is that exactly ?
But, so as to be sure not to infrige any copyrights in the future, as long as Panini pictures where in PD in 1996, meaning they have been published in Italy up until 1975, they're OK right ?
But according to your reasoning shouldn't all the following be deleted as well ? None of those have been uploaded prior to 2012 and some are even using the {{PD-1996}} tag which is not correct as they were published as from 1976.

@Garulfo71 Ricorda comunque che tutte queste foto le puoi caricare liberamente su it.wiki (dove non si applica la legge USA). Friniate (talk) 19:29, 7 May 2026 (UTC)
@Friniate OK, but this means they could only be used on it.wiki isn't it ? I wouldn't be able to use them on fr.wiki would I ? Garulfo71 (talk) 19:49, 7 May 2026 (UTC)
No, at least not directly (I have no idea about the local rules for uploads on fr.wiki, so if for example you could also upload there locally). Friniate (talk) 22:15, 7 May 2026 (UTC)
@Garulfo71: Please read Commons:URAA and Commons:Licensing. Wikimedia Commons requires media to be free both in their country of origin and in the USA. The note that this template must not be used for uploads after March 2012 was added over 10 years ago. And yes, there are more files here at Wikimedia Commons which need to be deleted for that reason. This deletion request is about files which were uploaded by you. I'll take a look at the other files and consider additional deletion requests. Regards --Rosenzweig τ 07:00, 8 May 2026 (UTC)

No. The point of agreeing is to show more support for deletion, which I've been told can make it more likely for an admin to make a decision sooner. The implication of that link is that if you have nothing new to say, shut up. I frequented COM:FPC for years, and that was not the attitude there and shouldn't be here. -- Ikan Kekek (talk) 00:00, 2 August 2026 (UTC)
"More support" for deletion without further elaboration does not change the consensus whatsoever. After all, such comments aren't even technically comments. They're just votes and "debates are not votes, [...] the closing admin will apply copyright law and Commons policy to the best of their ability in determining whether the file should be deleted or kept."
