I'm not sure where Haeberle's personal photos end and Haeberle's photos for the government begin, but I think being first published in LIFE magazine probably means not PD, going by the linked deletion.

  •  Keep. As a matter of fact, Haeberle claims he owns the rights to the photographs he took with his own personal camera. However, this claim has never been acknowledged in a court of law. On the other hand, the U.S. Army has regulated the copyright status of works created by its staff: AR 27-60 Intellectual Property. 2–12. Criteria for determination of domestic rights (page 3) defines four criteria for claiming "the entire domestic right, title, and interest in and to any invention" created by its staff. According to that part, all inventions of military personnel are in the public domain if they are made:
    1. During working hours
    2. With a contribution by the Government of facilities, equipment, materials, funds, or information, or of the time or services of other Government employees on official duty
    3. Which bears a direct relation to or is made in consequence of the official duties of the inventor.
    4. On assignment
So the scope of employment and official duties is important here. We know that Haeberle was a combat photographer assigned to the 11th Infantry Brigade, specifically attached as the public information photographer to Company C during the time he took these photographs, and he was ordered to do so during that mission. If Haeberle was a random soldier taking photos of a sunset for recreational purposes with his camera, that would be a different case. I strongly believe that criteria #1, #3 and #4 are met here. One may argue that the word "equipment" in criteria #2 (which I underlined above) disqualifies this work, nonetheless "contribution by the Government" is valid here. Even when the camera was not provided by the military, AR 27-60 rules that the U.S. Army still retains the right and interest, but "shall leave title" to the employee only if certain internal procedures are followed. Moreover, 2–14. Reporting of inventions required Haeberle to report the photographs he took with his camera (part of that certain internal procedure), which he intentionally did not. As a result, the U.S. Army could not even leave the title to him, let alone the rights. I assume that Haeberle only owned the tangible medium (36-exposure roll of color film, what he sold to Life magazine), not the copyright of the photographs, and the U.S. Army had a right to seize the negatives, even if they were not provided by them.
To sum up, the U.S. Army is automatically the owner of the rights to these photographs according to the regulation. Haeberle's copyright claim is not accepted by the U.S. Army, nor is judicially confirmed. The decision to keep the file in Commons:Deletion requests/File:My Lai massacre.jpg was right, in my opinion. I have been in touch with Ronald Haeberle personally about the ownership of his My Lai photos. He has maintained for many years that they are public domain and free to use. He has not claimed or established copyright on them. He is fine with them being used on Wikipedia.JohnKent (talk) 21:51, 16 February 2026 (UTC)

There is not even information about the photographer. The State Archives is research institution, not a place where a random person can request documents about a selected person and publish them themselves. It is unknown how the uploader gained access to the photo. It was likely scanned from a book. The template provided does not allow complete freedom to post any photos taken before 1994. COM:CR.  Info From Category:Images from Archives of Ontario - Sports Photographs "The collection documents sporting activity throughout the province, although most are from Toronto, Ontario. It features photographs taken by private individuals and organizations whose records were donated to the Archives as well as those captured by government photographers as part of the regular activity of various ministries, including the Ontario Ministry of Tourism and the Ontario Ministry of Education." I'm going to guess that the tags might be wrong. This could be a work that held Crown copyright, a photo dated 1973 from a government department would qualify for {{PD-Canada-Crown}}. If not, the Ontario Archives are quite open to licensing files in their collection with {{OGL-ON}} so that could be added instead. It is also possible they added the wrong year, I have fixed a few files from them that had vague or incorrect years. I will email the Ontario Archives to clarify its Public Domain status. The image is not at a set, a party, or press meeting. Also, the 404 may be an indication that BH no longer wants anything in the category under the permission. The image was uploaded by a person who bears the same name as the individual shown in the picture. It can therefore be assumed that this is the real person. However, the real person cannot simultaneously have been the photographer of themselves. In addition, this is the image officially used by the Bundeswehr, for example on the website of the Army Technical School. This therefore appears to be a photograph taken during working hours and for official purposes, and in my view Stephan Kurjahn cannot hold the copyright to it but the Army photographer will. I would ask for this to be reviewed, or otherwise for the appropriate permission to be obtained, if possible. Otherwise, this could constitute a copyright infringement. @SomeFancyUsername: The billboard itself sans the underlying images is a government work, but the underlying images do not appear to be. Some of the images show computerized renditions of the interior station design of the w:en:Metro Manila Subway. We already see too many red flags here, Wikimedia Commons-wise: every entity listed the billboard is all private entities: OCGlobal-JV and Tokyu Tobishima Megawide Joint Venture (a consortium of Tokyu Construction, Tobishima Corporation, and Megawide Construction Corporation). It is very likely that these computerized renditions of the subway station (which is still under construction) are authored by the people who work in any of those private entities. It is very unlikely that regular employees of the w:en:Department of Transportation (Philippines) created those computerized renditions.
Additionally, Sec. 176(3) of the PH copyright law permits retention of copyright should copyrighted works be used or incorporated in a government document (in the case of this image, the document is the billboard).
To verify, though, I'll ping some Pinoy Wikipedians who I think are familiar with either PH transpo articles on enwiki or the PH copyright issues: @RFNirmala, Ganmatthew, Lowkeypedia, LMP 2001, Chlod, Aristorkle, and Ralffralff: . JWilz12345 (Talk|Contributions) 13:00, 17 February 2026 (UTC)

I'm in agreement with JWilz12345 here. That said, I wouldn't be opposed to just censoring out the renders from the photo then revision deletion rather than normal deletion. There's useful info on the image that can be used as a reference for structured data. Logos at the bottom are probably de minimis and won't require censoring. The existence of censored images of landmarks from countries with no or insufficient commercial FoP rules is for the purpose of Wikimedia advocacies and, in the case of censoring images from countries with sufficient commercial FoP rules like from Germany and from UK, a form of Wikimedians' protests vs. threats to FoP clauses (like the European Parliament events of summer 2015). The performance is freely licensed, the composition is a more difficult matter to determine since the version the performer is using is from 1997 and the last surviving author (Francisco Grau Vegara) died in 2019. A friend just informed that the 593:398 flag should be uploaded to replace Viossa_Flag.png, as this file is indeed of that ratio, and because there is currently no public evidence that the 3:2 flag is used. I intend to reupload the files as Viossa Flag.svg (what I called Traditional Viossa Flag.svg) and Viossa Flag (3-2).svg (what I called Viossa Flag.svg).
It is necessary to upload both flags, as the issue has caused a lot of discussion in the community. It was decided that the flags with both aspect ratios should be uploaded as alternate versions of each other. I'm not sure how to cite Discord messages as a source. The administrator of the Viossa Discord server said "I just don't like the idea that we should try to get others to conceive of one as correct and one as not, as opposed to one in 3:2 and another in 583:398". Possible copyright violation. When the PD-old license was added in 2008, the photo was believed to have been taken by an unknown photographer in c.1897. In December 2018, the date was changed to c.1920/1930, while keeping the unknown author. Since then, the photographer has been identified as Emilien Barral, and the photograph has been re-dated to c.1922. Under the changed circumstances, we cannot simply "grandfather in" the previous license, as has apparently been done here.

For the license to have been valid in 2008, Barral would have had to be dead by 1938; but he was definitely still alive in 1944. The question we need to answer now is if the license is applicable today. For that to be the case, Barral must have passed away before 1956. Proof of his death pre-1956 needs to be added. See Commons:Copyright rules by territory/France for the French copyright rules. For anonymous works, it is "Publish + 70 years"; otherwise it is "Life + 70 years". This means the license was okay-ish as long as the photo remained anonymous (depending on what counts as "publish", but that's a moot point now), but as explained above, it may no longer be okay now. For the same reasons as there, the image probably should be deleted even if the author is found to be unknown (and definitely needs to be deleted if the author is Barral, nothing has changed about that). Barral printed many of these photos as postcards, so that might count as publication. We don't have copies of this particular photo as a postcard but there is one showing Yvonne in the same costume as part of a group. The reverse side is a postcard with Barral's stamp. Another one shows Yvonne's sister-in-law where the camera is in exactly the same position as the photo of Yvonne, i.e. it was on a tripod that was not moved between the photos. Again this is a postcard with Barral's stamp. These were discussed on forums but not in any form that would count as a reliable source. Weburbia (talk) 13:49, 24 March 2026 (UTC)
