Generally, the person who took the photo is the one that can control the photo copyright, unless they sell or give those rights away to someone else. For example, if I buy a postcard, I can't scan the postcard, put it on commons, and say it's "via" me. I can own a collection of photos, but that doesn't mean I own the rights to declare them all CC-SA-4 or PD. --Dual Freq (talk) 22:20, 9 December 2024 (UTC)

You'd have to find out who took the photo, unless you can prove that one of the others purchased/inherited the right to distribute it to someone else. Just be cause a photo is in my collection doesn't mean I own the right to relicense it. --Dual Freq (talk) 23:37, 9 December 2024 (UTC)

Do you think Public Domain of this photo if fine ? It has added Template:No permission since by @Aviationwikiflight with reason: Possible copyright violation based on this (see the Flickr about page): "The Air & Space Museum does not warrant that the sharing of these images will not infringe upon the rights of third parties holding rights to these works. It is your responsibility to determine and satisfy copyright and other use restrictions before copying, transmitting, or making other use of protected items." Regarding File:Douglas DC-8 Emery Worldwide.jpg, the Air & Space Museum does state (on their official website) that The Museum’s images that are part of The Commons are marked “no known copyright restrictions,” indicating that the Museum is unaware of any current copyright restrictions on the works so designated, either because the term of copyright may have expired without being renewed or because no evidence has been found that copyright restrictions apply. However, their notice on flickr seems to be slightly more cautious as was stated on my edit summary. The edit was precautionary, in case something was missed. Regarding the two others, it would be nice to know when the images were published and whether or not a third-party owns the images, because for all we know, the images could've have been published after 1977 and might still be copyrighted. I don't really need to be involved, but I would follow the Precautionary principle, where there is significant doubt about the freedom of a particular file, it should be deleted. I'd prefer for the actual photographer to be credited in most cases and for it to be more clear where the photo came from. In the case of postcards, someone probably holds copyright to those, but I'm not going to track it down. Dual Freq (talk) 22:14, 18 December 2024 (UTC)

Anonymous photographer

It probably depends on a lot, year, country, etc. I would think that if they sold the rights to someone else, then that person can license the photo to commons. If they did not give up their rights or license it to the other person, then the anonymous person would seem to still own the photo. Commons:Village_pump/Copyright might be a better place for you to get specific questions answered by the community. Commons:Hirtle_chart indicates anonymous works created after 2003 are not PD for 95 years from publication OR 120 years from creation, whichever expires first. --Dual Freq (talk) 22:35, 10 January 2025 (UTC)

Originally I uploaded this image to Wikimedia Commons with the CC-BY-SA 3.0 license here, according to I see on the website I took it. However, now it is nominating for deletion, since the license maybe wrong and the user nominated thinks it can be in the PD but needs to be cheecked.

I gave many evidences from websites show that it was published before 1956 and no copyright notice, and now I edited the license to PD-US-no-notice. Tô Ngọc Khang (talk) 02:11, 14 June 2025 (UTC)
